Fumigation Litigation

Commodity Fumigation is one of the most dangerous and regulated areas of pest management. When used properly, fumigants are highly effective. When used improperly, human injury, fire / explosion, product adulteration, and equipment damage can occur. Fumigants are regulated at every level of our society; Internationally, Federally, States, and Counties. 

A pesticide label is federal law.  Fumigants are pesticides and fumigant labels are lengthy, complex, and intentionally vague.  Understanding if these laws have been violated can be difficult.  FIFRA, Cean Air Act, RCRA, Environmental Justice Zones, are just a few sets of laws that can impact fumigation.

Toxic tort lawsuits are very challenging when fumigants are involved – for each side.  These services lack transparency and if you do not have a way to connect the law with the dynamics of application and context of events, these cases can be grueling.
